9 apply for open West Virginia Supreme Court seat

Nine people have applied for an open West Virginia Supreme Court seat.
Gov. Jim Justice’s office says the applicants are C. Haley Bunn; Nicole A. Cofer; Robert J. Frank; Gregory Howard Jr.; Charles O. Lorensen; Kristina D. Raynes; James J. Rowe; Mark A. Sorsaia; and Joanna I. Tabit.
Bunn practices with Steptoe & Johnson PLLC in Charleston. Cofer is a traffic safety resources prosecutor with the West Virginia Prosecuting Attorneys Institute. Frank has a Lewisburg law firm.
Howard is a Cabell County Circuit Court judge. Lorensen is a member of Kay Casto & Chaney PLLC in Charleston and a one-time chief of staff to former Democratic Gov. Earl Ray Tomblin.
Raynes is a Putnam County assistant prosecutor. Rowe is a senior status judge retired from Greenbrier County circuit court. Sorsaia is Putnam County’s prosecuting attorney. Tabit is a Kanawha County circuit court judge.
Former Justice Evan Jenkins resigned last month to return to private practice.
The governor’s office says a judicial commission will interview candidates in the coming weeks and recommend finalists to him.
A bill awaiting Justice’s signature would let the appointee first face election when Jenkins’ term is up in 2024, rather than holding a special election in November.

Not guilty plea entered in alleged drug deal slaying

A defendant accused of fatally shooting a man because he didn’t want to pay him for a drug deal pleaded not guilty in Brown County Circuit Court Monday.
Pedro Santiago-Marquez is charged with first-degree intentional homicide and being party to mutilating a corpse in connection with the Sept. 27 murder of Jason Mendez-Ramos.
Prosecutors say Mendez-Ramos was angry that he had not been paid $80,000 for a cocaine deal. A criminal complaint says rather than pay for the cocaine, Santiago-Marquez shot him in the head with a pistol. The victim’s burned body was found at the edge of the University of Wisconsin-Green Bay campus, WLUK-TV reported.
Security videos, cell phone tracking information, and DNA tie Rodriguez-Garcia to that scene, according to the criminal complaint.
Another man, 47-year-old Alexander Burgos-Mojica, is charged with harboring or aiding a felon in connection with the case. He returns to court March 18 for a balance of initial appearance. Rodriguez-Garcia returns to court March 21 for a status conference on the charge of mutilating a corpse.

Gangs control who eats at Mississippi jail, monitor says

Gangs inside a Mississippi jail often determine whether other inmates receive meals, a court-appointed monitor testified in a federal court hearing.
Elizabeth Simpson testified Tuesday that staffing shortages are so severe at Hinds County’s Raymond Detention Center that gangs and “inmate committees” control certain aspects of life, including whether some inmates get to eat, WLBT-TV reported.
A former administrator of the jail, Maj. Kathryn Bryan, learned staff would put food on carts to take to the jail’s housing units and would let the inmates distribute it, Simpson said. In two cases this January, detainees in a mental health unit were suffering severe weight loss as a result, Simpson said.
U.S. District Judge Carlton Reeves issued a civil contempt order Feb. 4, saying officials in Mississippi’s largest county have failed to fix problems at the jail. He started holding hearings last week to determine whether to order a receivership in which the federal government would take over operation of the jail, with Hinds County paying the tab.
Simpson testified Tuesday that inmate committees determined whether certain detainees could remain in housing units known as pods.

Moats named to temporary seat on West Virginia Supreme Court

A circuit judge has been appointed to a temporary seat on the West Virginia Supreme Court after the resignation of Justice Evan Jenkins.
Chief Justice John Hutchison on Monday appointed Alan D. Moats to the high court. Moats has served in the judicial circuit covering Barbour and Taylor counties since 1997.
Moats will serve on the Supreme Court until Gov. Jim Justice appoints someone to the seat. That person then would serve until an election can be held for the remainder of Jenkins’ term through 2024.
Jenkins announced Friday that he is resigning to return to private law practice.
Jenkins was appointed and then elected to the seat of retired Justice Robin Davis following the Supreme Court’s 2018 impeachment scandal.

Some Michigan counties pause jury trials amid COVID surge

Jury trials have been paused in some western Michigan counties due to a surge in coronavirus cases, court officials said Monday.
Chief Judge Mark Trusock said all jury trials in Kent County 17th Circuit Court, based in Grand Rapids, were on hold until March 7. Ottawa County Probate Court and the 20th Judicial Circuit Court, based in Grand Haven, will not summon the public to courthouses to serve as jurors until at least Feb. 1, according to a statement released by the court.
Michigan health officials said last week that the state’s record-high COVID-19 cases and hospitalizations could peak in late January or early February, and they urged the public to take steps to help control the spread.
Ottawa County court officials said their decision was made in consultation with the Ottawa County Department of Public Health. Circuit Court Administrator Susan Franklin said judges don’t want to bring large numbers of people into the courthouses given the current rates of COVID transmission.
Courts across the U.S. have paused jury trials at various points during the pandemic. The highly contagious omicron variant has prompted additional pauses in recent days, including in Indiana’s largest county and in the state’s second most-populous county.
